Abstract | The attempt of research study is to evaluate the PPP regulations for road construction projects in Myanmar. Based on PPP/ BOT scheme, this research was evaluated the strength and weakness of the existing regulation in orde r to improve the quality of the roadway projects. The typical procurement of process phases of PPP is used to compare with exiting BOT contract in order to find solution to make better rule and regulations. The research was found that there are many barr iers such as lack of equity, poor bankability and insufficient budgets to speed up the social and economic development. Moreover, the BOT system and contracts between MOC and private companies are unclear and contain content that is unsuitable for legal do cumentation. It was also found that liability and obligations for any kind of business risk are not considered in unclear BOT contract. By considering the currents BOT system and related contacts found in this study, the possible recommendations for successful implementation of BOT scheme were provided. |
