AbstractCustomary law is a set of rules in people’s interaction with natural resources and the spirits. By c omparative case studies on water resource use and management of M’Non g people in Dak Lak province, Vietnam, the research found that customar y law sets rules for wat er resource use and management. Customary law ensures a formal procedure of decision making in managing the water port of the village with the involvement of all villagers . Especially, traditional institutions such as the village pa triarc h , the village elder board and the village self - governance board play crucial role in decision making . Customa r y law contributes to strength en ing people’s awareness of water protection. Traditional M’Nong people are willing to give up material value to protect the spiritual value of the water port. Especially, water resource use and management under customary law seems to improve both water quality and the environment around the water port. In addition, the reseach also found that water management und er customary law applies a participatory approach while a top - down approach is applied by local government. The case studies of M’ Nong people indicate that there are some differences between customary law and state law, of which, customary law is stronger than state law in governing the water port of M’Nong people. Based on the findings, the research gives several recommendations to promote customary law and integrate with state law toward s good water resource use and management.
