AbstractIn Vietnam, Real estate development has important effect to society as well as economy. The development constitues a significant portion of gross domestic investment that the government has special consideration on real estate development as an industry, the industry that partially leads and support the other industries. The development shapes the habitat and forms the built environment. Real estate development relates to two important matters: Land development and housing development By the nature of the Vietnamese political system and the vision of the state development, although land is state owned, but the goverment has had concentrated in the progress of urbanization. More and more new urban plannings are executed that strongly change the appearance of towns. The domestic private investment is encouraged with many open policies, attracts investors to join the real estate development. In the recent 20 years, the operation of real estate development was actually a main factor to make economic boom that the government need to control to get good effects for the economy and society. The government have promptly promulgated laws and regulations to harmonize the benefits of all relevant parties to maintain the progress. As an investor, to be competent in applying legal development process is critical in order to ensure the project is complied with laws and regulations. In other hand, legal process is one of sufficient processes of project implementation. It is hard to control the time frame of legal process because of many objectives existences that are generated by the un clear regulations. This is obviously risk to the schedule. This final report is reviewing the particular Ho Chi Minh City legal process of real estate project development to analyse the factors that affect to project implementation, and propose efficient approaches which can help the real estate investors control their legal process in a best way.
