Abstract | HRM is endlessly dynamic and fluctuating because of the nature of business---it is about managing people, and people are the most difficult of all resource to harness and come to terms with. East and South-east Asia has such a huge labor supplying market in the world, especially in China, there exists a quarter of world's workforce, becomes a major component in global employment development. Therefore, related legal issues study become more and more important in HRM area. At the same time, the combination of HRM with relevant labor legislation provides the opportunity to focus on the regulation of industry and the parties to the employment relationship. Different country has different legal system; this paper examines the labor legislation system in China and Thailand, and compares the labor law practice within HRM sector, such as worker rights, employment contract, employment termination, sex discrimination and labor dispute settlement, in the two countries. The similar and different characteristics in labor law are summarized after the comparison. With the different labor legislation practice, high compliance rate and effective labor law enforcement can help the firm to achive the goal of profitability maximize through effective HRM activities. There are some obstacles of labor law enforcement in both counties. In order to develop a health labor market and provide a appropriate economic operation environment, the firms should contribute more affords on HRM activities legitimated and the governments also be require to update and enacting relevant laws to cover the problem raised. |
