AbstractThe music industry has been hit by one of the major crisis of its history since the late 1990s. Meanwhile, the musical works, which were until then under the usage rules defined by the copyright and related rights of the Intellectual Property, started to be shared freely, without any authorization by the rights holders over the Internet through the peer-to-peer systems. The main actors of the music industry accused the huge shares of illegal music files in the Internet as the reason for the crisis of the sector. But a deeper study of the structures of the industry reveals a declining technology, the CD, and new needs of consumers that the illegal digital systems forecasted before the industry itself. It appears that what has been seen as the major threat for music creation and industry is becoming the opportunity to be harnessed. Indeed, the Internet offers new ways of communicating the works and new supports to diffuse them. This is obviously very challenging and it questioned the whole previous legal and business model. To achieve the design of that new model, based on online sales of digital music, a new lega.1 framework has been required. The aim is to recreate an environment of confidence for artists, so that creativity can prosper freely, and so that musical works are made available legally on the Internet. The strategy of the States and the labels today is to change the behaviors of the public to make them gear towards the legal platforms of digital music. Nevertheless, this strategy may be misleading to a certain extent: deterring people from using a technology, the P2P, which is today part of their habits, is very likely to fail at the end. Then, the music industry might have to learn how to make do with P2P systems within its new model.
