AbstractAs its evolution in 1978, Collaterlized Debt Obligations (CDOs) continue to become an increasing part of asset-backed securities market for the last decade. In 2003 and 2004 CDOs constitute over 10% of total ABS issuance, up from under 1 % of the market eight years earlier. CDOs become established in Asian emerging market as an innovative financial instrument for financial institutions and investors to achieve a variety of objectives. Most of CDOs transactions in Asia are set up for investment purpose. Some prominent deals in Asia are presented in the study. In Thailand, CDOs are becoming an interesting alternative investment for banks, financial institutions, and professional investors to enhance higher return. However, issuing CDOs deals in Thailand is still rare because of excess cash reserve condition and regulation constraints. Until now, CDOs in Thailand has just been in a preliminary stage of study. Thai financial institutions, especially, local banks, study CDOs proposed by foreign banks for investment objective. Currently, Banks of Thailand has just enacted specific law and regulation for CDOs on August 2004. However, this regulation permits banks to invest in CDOs transaction, excluding issuing of CDOs deals. Nevertheless, there are no specific accounting and taxation treatments for CDOs in Thailand, which will lead to major obstacles for investing in CDOs. The prospects for the future market development will depend on many factors, both from the government and financial institutions. The government should formulate precise regulation covering all aspects of CDOs while financial institution should take an active action in studying and preparing themselves for participating in this market.
