AbstractSelection of the most appropriate form of contract is of prime importance. Project size, design responsibility, complexity, program and costs are all issues which should be considered before a particular contractual arrangement is adopted. The Vietnam construction industry has a variety of contrnct forms. They are used by different people under different conditions. An exploratory study of specific experiences with particular contract forms informed us on the value of the fo1ms for project risk management. Respondents of this survey included personnel from owners, consultants and contractors involved in construction projects in Vietnam. The results of the study revealed the main problems related to using those forms and contract management such as government procurement practice, differences in standards, differences in culture, interpretation of contract document, law governing contract, fairness of contract conditions, owner or designer changes, contractor changes, dispute resolution. Problems related to fairness of conh·act conditions were found in a case study. Because of the interests at stake and also because of the complexity of the works and cultural relationships, risks of dispute are high. Indeed the consh·uction industiy is the main generator of dispute. How are construction disputes resolved in Vietnam? This study also verified method of dispute settlement in the Vietnam constiuction indushy.
