Abstract | Market manipulation is an important issue especially in emerging markets such as Thailand. The regulatory authorities have been trying to supervise trading activity in order to ensure fairness of securities trading and adequate investor protection. Several regulations and measures have been enacted under the Securities and Exchange Act B.E. 2535 in order to govern manipulative practices but a number of cases relating to fraud practices are still being examined each year. Several patterns of manipulative trading behavior have been found. These include pool operation, matching order and wash sale, series of transaction and price leadership, queue intervention and concealment of other person's order, entered and subsequently cancelled order, directing the price as well as market cornering. The investigation procedure of market manipulation cases involves several agencies working independently to conduct investigations under their own jurisdiction. The main challenges in proving and investigating stock market manipulation case are the following issues: understanding of the parties involved, lack of cooperation between the relevant authorities, the appropriateness of the laws and regulations application and lack of effective penalty system to promote deterrence of manipulative behaviors. |
