Women's career development in the judicial institutions of Mongolia

AbstractSince the last century, the gender inequality is being world widely questioned, especially in western countries. Women have made a lot of progress in seeking for their rights to be equally treated as men. However, there is still a long way to go for women especially in developing countries where because of socio-economical and cultural reason women are still being discriminated in workplace or in day to day life. As a developing country, Mongolia is not an exception to that fact. This study is interested mainly on the situation of the promotion of the women in the highest position in the judicial system of Mongolia. In fact, although the statistics has shown that since 2 decades, more women are attending the university than men and more female students are choosing the law studies compare to men, we found a very pertinent situation in the judicial system. The rate of female population among the law professionals is much higher than men (around 60% of women and 40% of men) but in highest positions the trend is the opposite_ Most of the high ranked positions are occupied by the men. The aim of this study is to try to find out the reasons behind that situation whether there is discrimination towards women in the system or if there some factors are preventing women to get promoted in the highest positions. As methodology, we used qualitative and quantitative data collected from the Mongolian Judicial system and by interviewquestionnaire survey performed during 3 months among the key informants in the judicial system. The results showed that both men and women agreed that the women are as well qualified as men to occupy any position in the system. But according to the high ranked men interviewed, the women may not be emotionally prepared to occupy highest positions and may not be able to assume that responsibility without being affected by other factors such as the place of women in the society and their reproduction role. Age wise analysis has been done on the promotion in the judicial system. It has been found that even at the same education, experience, ability; male professionals are promoted earlier than females in all the levels of the court and prosecutor's office. After analysis at the policy and human resources management level, we found that GCC (General Council of Court) and PC (Professional committee) of SGPO is the key player of the process of promotion or recruitment. It has the role of organizing any required test and then pre-establish a list of the candidates to be submitted to the President of republic for formal confirmation. But the GCC itself is composed of 14 members with only 1 woman. We may therefore doubt on the objectivity of the GCC in term of gender equality. It has been also found that at the same level of education, experience, and professional skills men are promoted earlier than women in all levels. In conclusion, the policy level is accountable of the discrimination found in the process of promotion of women in the Judicial system, in particular at the high ranked position. The policy and HR should take into account the socio-economic, cultural environment of the Mongolian society in the implementation of the process of selection and promotion. By failing to do so, we can consider the policy as discriminatory
