Abstract | In 1997 there was a signal of financial crisis in Thailand, many companies have been inevitably effected. The governments have tried to control this problem and estimated that securitization may be an alternative among others to solve the liquidity problem. Securitization has been foreseen by the earlier government since B.E.2523 but the development process is at slow pace. The two Emergency decree have been introduced in B.E.2540 to promote securitization in Thailand but it seems still some problem in the interpretation and ambiguity with other law and Regulations which make it is so difficult to implement. There is also other issues which are also important to the securitization development such as the Tax issues, Accounting Issues, Economic Condition and Investor Base in the local debt market. At present the securitization that implemented by Thai Originators have been done successfully only 3 transactions out of 4 transaction and they were not fully maketing in local markets. All of them were offshore securitization. There is still ambiguity in implementing securitization although there are laws and regulations issued by government. Taxation is also another issue. There is still cannot apply the tax-exempt to securitization because the regulation is not broad enough. Although it is quite complex to nurture securitization, but it is an important longterm measure, that can strengthen the financial system and to mobilize capital in Thailand. |
