AbstractIn the context of market economy, Ho Chi Minh City needs an efficient urban planning system to cope with the dynamic trend of development activities from foreign and local investors. The regulations and planning system at all levels are still not effective to enhance the development control process and to provide legal framework for public infrastructure investment by both the government and private sectors. This research tried to look in the overall planning background and planning context of Ho Chi Minh City by secondary data and analyzed the planning functions of the city based on the Chief Architect Office's self-assessment. It examined the violation status of development control in a few urban districts by primary data of building permit records. The thesis also assessed some of the related studies of international experts of AusAID project in Hanoi and UNDP project in Ho Chi Minh City to emich its recommendations for the development of the urban planning system. The findings of this research are a chain of constraints and weaknesses in planning legislation and administration associated with both plan making and plan implementation processes. This research carried out three main messages: Firstly, alteration should be made in the existing development control procedures especially in the time limit and the strict enforcement of the process by appropriate changes in planning regulations and administration. Secondly, improvement is needed in the plan system and technical making process to make the plan itself flexible to adapt with the new situation of the market-oriented environment and to provide sufficient guidance for private sector's developments. Thirdly, the strategic planning approach should be wisely incorporated in the traditional one to set up a mechanism for meaningful participation of all concerned government departments, business sectors and communities in both plan making and implementation process.
