Abstract | Today, intellectual property is an issue of universal concern in the political, economic, scientific, technological and cultural exchanges. As a whole, China, however, for a variety of historical reasons, began work on its intellectual property rights protection system at a comparatively late date. After China started opening to the outside world and orientated reforms, it accelerated the process of establishing an intellectual property rights protection system. China has attracted worldwide attention for its achievements not only in establishing the system but also in enforcement. China began to adapt market economy from 1993, but most of these laws and regulations are published before 1993. So there has an inconsistency between market economic system and the legal system that was set up under plan economy system. Through this study, we found problems of legislation, implementation, and non-legal factors that in China. After we analyzed these problems and compared with other countries' legal system, we made our recommendation that the Chinese government should improve intellectual property protection by legislating new laws, and improving implementation. Public cooperation is important for intellectual property protection too. |
