Abstract | This research case study is focused on the impacts suffered by the contractor due to COVID-19 in ongoing construction projects in Malaysia and Nepal. Construction projects encountered multiple delays in work progress and incurred extra costs for multiple reasons. Change in method and sequence of everyday construction work like implementation of social distancing and other health and safety measures have greatly impacted the contractor. Contractual implications like claims and disputes in construction projects have been encountered everywhere due to the unanticipated occurrence of the pandemic and the global surge of infections. Through this multiple case study approach, claims induced due to COVID-19, methods used to calculate damages in practice, records required to substantiate a claim and measures taken to avoid further claims were also explored. Furthermore, the claims that are easily settled and that are difficult to settle were analysed through this study and this has been an important finding of this case study. Lastly, contractor’s recommendation on the kind of measures that should be taken in future were also extracted. Data collection was done by taking in depth interviews of project informants through open ended questions and reviewing the relevant contract and claim documents. Findings from this research can be used to understand the impact of force majeure event on construction projects and claims induced due to force majeure events like COVID-19 in detail. |
