AbstractTo be successfully achieved with fairness among the parties, a construction project must describe requirements and obligations in contract terms and conditions. During the construction phase, a contract can enforce through systematic contract administration. Naung Pi – Ti Lon – Moe Oo – Nam Pha Mu Rural Road Construction Project was chosen as a case study. It is one of RDP’s projects in the southern Shan State of Myanmar and financed by KfW DB, Germany. DRRD, MOC was performed as a contract management team in this project on behalf of the government and, on the other hand, the local contractors constructed the road construction. The FIDIC construction contract has been signing, between DRRD and the local contractors. The contractual documents comprise two parts which are general conditions (GC) and particular conditions (PC). The general conditions can see as a general framework that applies to many construction contracts, whereas conditions subjected to variations and additions are in particular conditions. These contractual documents are very effective and well balanced between the parties. From this case study, the strengths and weaknesses contained in the contract can highlight the dispute and conflict. So, the construction industry can avoid the lack of knowledge in contracting practices, especially in Myanmar. Even though some parts of international administration practice are needed to be tailored more convenient, understandable, reasonable policies and cultures, contract agreements can adopt and represent systematic processes in the construction contract administration and management fields. A construction project with an unsystematic contract document cannot handle the work to comply with specifications set out in the contract and meet the owner’s requirement. Therefore, every performance and activity carried with reference terms and conditions stated in the contract agreement by both parties; owner and contractor.
