AbstractMyanmar is a developing country and it has progressed slowly in industry, manufacturing and construction sectors. BOT which stands for the Build-Operate-Transfer scheme has become a popular method of developing infrastructure in Myanmar so that future economic progress and improvement can be supported. For foreign investors, they have various opportunities. Nevertheless, there are several risks and problems resulted from the dissimilarities in legal systems, market situations, and culture. Foreign investors must be able to classify and cope with the critical risks relating investments in the infrastructure projects of Myanmar's BOT. According to the survey, some of the serious matters were identified: delay in approval, changes in law, overrun of cost, communication restriction, land achievement and compensation, contract enforceability, construction schedule, monetary closing, tariff modification, and risk of environment. Each of them is suitably moderated. As a final point, a structure for agreement supervision in BOT projects is made. The crucial objective of this paper is to examine several kinds of matters related with the projects of Build Operate Transfer in Myanmar.
