| Abstract | Flood and landslide emergency recovery project were located in Rakhaine Stage was selected to do case study of the project. The project has applied international contract document (FIDIC, pick book) to execute it as the project was funded by World Bank. The contract agreement was very effective and well balanced from holding a fair balance between the interests of both parties to the contract. DOH, MOC was proceeded as an agreement supervisory crew in this project for government and the local constructer for hire on the others hand to execute road construction project. In this case study, not only the strength of conditions contained in the contracts of a construction project, but also the weakness of that contract conditions can be highlighted. It found that due to lack of knowledge and poor in English skill, the contractor failed to perform the work properly especially in safety, health, and environmental protection. In fact, there was not mention penalty clause for this. At the initial stage, the work process in not smooth as the parties did not familiar with international practice. But later, it found better and easy to adopt it as most of the process procedure were developed and clear. The project failed to complete as per original schedule and it has claimed six months additional extension of time to complete it due to work volume increase and COVID 19 restriction. |
